1. Penny. As I write this, the Daniel Penny jury just reached a verdict. He was found not guilty of reckless endangerment. This charge requires precisely the same elements of a crime as second-degree manslaughter, which the judge dismissed Friday. What comes afterwards is anybody’s guess. On to the review of last week’s festivities. The Penny jury twice told the judge last week that they were unable to reach a unanimous verdict. He sent them back after the first time. They came back a day later with the same conclusion. The Manhattan DA moved to drop the manslaughter charge, which the judge did over the objections of the defense. The judge then sent the jury home for the weekend to reconvene this morning. The defense noted that the only way the reckless endangerment charge could be considered is if the jury found Penny innocent of the manslaughter charge, which they did not do. If true, this means any conviction can (and should) be overturned on appeal on procedural grounds. The judge noted Friday that there may be a problem with his action but took it anyway. Some observers viewed the judge working with the prosecution to dismiss the manslaughter charge as an attempt to ju-jitsu the jury into a conviction on the less serious charge. It didn’t work. The funny part about these machinations is that had the Bragg DA shop not gotten cute and tried to entice the jury to convict on the lesser charge, they would have had a mistrial which would allow them another trial. Once the manslaughter charge was dismissed and the reckless endangerment charge ended up as a not guilty verdict, there will be no second trial. As an aside: is corruption as rampant among NYC judges as it appears from the outside? We saw the outrageous conduct of Merchan and Engoron during the two Trump trials in NYC. Now we have this guy, who is also working with the prosecution. Quite the judicial system you guys have in NY these days. You must be very proud. Professor Dershowitz blasted Manhattan DA Alvin Bragg and his office for being the worst DA in modern NY history. He went on to describe the entire case being based on racism, specifically anti-white racism (my words, not his) coming out of the Manhattan DA office. Final bit of news was the announcement by Jordan Neely’s father of a wrongful death civil lawsuit filed against Penny. No explanation by the father why he allowed his cherished son to get himself so hopped up on drugs that he was uncontrollable for years. Happily, Penny is not without resources, as there is at least one GoFundMe (or similar) operation raising money to cover his current and future legal fees.
2. Pardon. Joe Biden issued his first pardon a week ago. This was an expansive pardon of his son Hunter for all criminal actions real and imagined starting in 2014 over the subsequent decade. Democrats who bought the Big Lie from Scranton Joe that he would not be issuing any pardons to protect Hunter are shocked, simply shocked. Those of us on this side of the political divide, not so much. There is much speculation about how many other pardons he will issue. My guess is that he will most certainly issue pardons protecting his extended crime family and his criminal enterprise. He might even pardon himself. The growing chorus from the media and other democrat cheerleaders are calls for him to issue a series of preemptive pardons for members of his regime involved with lawfare, the Jan 6 prosecutions, the Jan 6 House Committee, various FBI and Do(In)J vermin who participated. This corrupt man is being called to pardon people who haven’t even been accused of crime. I kind of hope he does this, as he paints everyone he pardons as a criminals. Better yet, he removes the ability of everyone pardoned to take the Fifth Amendment and refuse to testify based on possible self-incrimination. And the Hilary-esque “I can’t recall” won’t work anymore either. There will be investigations, and every bit of information found by those investigations will be released to the public. If those investigations can’t send the actual perps to jail, they can most certainly get all their enablers. And there were a lot of enablers.
3. Cali. The new trick in California to diddle elections was same day registration. This led to the month-long ballot counting and eventual flipping of three Republican congressional seats in Orange County to democrats. Among new cute actions during the counts were bomb threats. Counting was halted, rooms were cleared, and unmarked vans showed up outside the counting locations while the buildings were being searched for devices. This happened in Orange, LA and Santa Clara counties. The longer this goes on, the more corrupt Cali demonstrates it has become under one party democrat rule.
4. Tesla. For the second time, a Delaware judge ruled that Tesla CEO Elon Musk is not entitled to a $56 billion compensation package. The opinion echoes her first opinion in January that called the first compensation package excessive. Her excuse tossing it was that Musk has too much influence on the Tesla Board of Directors. This time around, the compensation package was approved by the general membership of Tesla stockholders, something the judge also rejected, piously claiming that the Tesla Board was not entitled to hit reset to restore the compensation package. She claimed that Tesla made multiple misstatements in its proxy statement regarding the vote. End result was no pay for Musk and a 1.4% loss in the price of Tesla shares within hours of the ruling. Now, this wasn’t all bad news, as the judge also massively limited the payment demanded by the stockholder’s legal team to $343 million. They had requested 29 million Tesla shares, over $10 billion at today’s prices and legal grounds to act as aggrieved shareholders filing lawsuits against Tesla for decades come. The $56 billion compensation would be worth $101 billion at today’s Tesla stock prices. Expect Tesla to come up with something in Texas now that they have moved their incorporation from Delaware (Biden-land) to Texas. Musk will have to be careful how he does this, though as the democrats and their highly compensated sharks are still out there waiting for another bite of the apple.
5. Brazil. I think we found the reason that Brazil went after Elon Musk and Starlink. Censorship demands aimed at Twitter / X was just the excuse. The real reason was that SpaceSail, a CCP company specializing in LEO satellite internet was trying to enter the Brazilian market dominated by Starlink. A MOU between China and Brazil signed during President Xi’s state visit in Nov is SpaceSail’s first attempt to offer satellite internet outside China. Most reporting of the MOU and SpaceSail describe the MOU as coming after the Musk Starlink standoff. I believe this to be incorrect, as the censorship was simply an excuse to pick a fight with Musk. Starlink at the time appeared to be collateral damage, when in fact the censorship was the excuse and Starlink was the real target so that the Lula regime could play patty cake with the CCP. Enjoy it while you got it guys. Musk smartly chose to back off until after the election. I expect the new Trump foreign policy team will have some interesting discussions with both Brazil and the CCP about this affair.
6. Retirement. Every time Republican leadership under Mitch McConnell make some sort of deal with Chuck Schumer, they end up getting stabbed in the back. I am forever reminded of the clip from Animal House below. Majority Leader Schumer is trying to shove through just as many last-minute Biden judicial nominees through senate confirmation as he possibly can before Jan 3 when they lose their majority. Republicans view the appellate seats more important than the lowest level, so they made a deal. Schumer promised three democrat sitting judges would submit their retirements before Jan 3 in return for Republicans not fighting the other nominees that hard. Foolishly, McConnell and his team took the deal. Immediately following the election, two of the democrat appointed judges changed their minds about retiring. Surprise. Surprise. Surprise. McConnell blasted the naked partisanship of their conveniently timed change of heart. Play stupid games. Win stupid prizes.
7. Dominion. Following the 2020 election, CO Secretary of State, the same woman who allowed the list of Dominion passwords to be posted on the internet for months before the election, notified county clerks that Dominion would be visiting their offices to install a “trusted build” on their voting machines. The build would overwrite all data stored on the machines. Mesa County Clerk Tina Peters took steps to preserve the data. She was prosecuted and convicted by the State of Colorado for election interference for doing so. Note that county clerks are required to preserve election records for 25 months following each election. When the Mesa County record was analyzed, by investigators, they found the database had been deleted and overwritten during the election. Dominion itself deleted election records from the county machines, breaking state and federal law. An investigation by the Mesa County DA found the problems were caused by human error, blaming it all on Peters. Peters was charged with multiple counts and convicted on a few of them. She is now appealing the convictions. It turns out that Dominion has a close working relationship with many, if not most county clerks but also state election officials. Peters’ predecessor and team worked with Dominion in the two years before the 2020 election and continued to get e-mails from Dominion after they moved to new positions in the Treasurer’s office. Peters was specifically excluded from e-mail traffic between Dominion and county election officials statewide. Following the election and discovery of Dominion reprogramming and carrying two election databases, the former election officials still working with Dominion assisted the public campaign against Peters. There’s even a Biden Do(In)J connection which shouldn’t surprise anyone. The Gateway Pundit piece on this is long and detailed. There should be a lot of people in jail should this all be true. The bottom line is that the vendors own Colorado elections and election officials. I wonder which party these officials are members of (/sarc)?
8. RoK. Politics in South Korea (Republic of Korea, RoK) is often a full body contact affair, something we’ve seen over the last couple weeks. RoK President Yoon announced martial law as a way to combat what he called anti-state forces who were plotting rebellion. He also claimed the main opposition parties were supporting North Korea. The announcement was a shock and quickly reversed by the RoK parliament. As one might expect, this really stirred things up, and all government entities got themselves involved. The RoK military announced they would not participate in enforcing future Martial Law declarations from Yoon. Members of Parliament are working on impeaching and removing Yoon as he has refused to step down. Yoon was elected in 2022 and gets to deal with a parliament controlled by his opposition.
